New Jersey Custody Defined
New Jersey custody law allows for both parents to have as much time with their children as possible. However, the courts generally look to see what is in the best interests of the child when determining a custody agreement. There are two types of custody:
- Physical custody: If you are given physical custody, you are essentially given physical possession of your child, and are in charge of their day-to-day activities and decisions.
- Legal custody: With legal custody, you would have the right to make major life decisions on behalf of your child regarding issues such as education, religion or health care.
Legal custody responsibilities are often shared between parents. Physical custody can be sole or shared, and can be determined by the parties or by the courts.
